Pre-Filing Bankruptcy Credit Counseling - User Agreement

The Pre-Filing Credit Counseling consists of 3 steps.

  • Online course - This portion is available 24 hours a day, 7 days a week
  • Financial Analysis Review - A credit counselor will issue a Financial Analysis upon completion of the online course. Our credit counselors are available and financial analyses will be issued during the hours of 8:00 am – 8:00 pm PST. An email will alert the Debtor(s) the financial analysis is ready to be reviewed. The financial analysis is accessed by logging back into the website. Once the financial analysis has been issued access to review is available 24 hours a day, 7 days a week.
  • Interaction with Credit Counselor - After reviewing the Financial Analysis the Debtor(s) will certify that they have reviewed the recommendations provided and will be given the opportunity to discuss any class or Financial Analysis topic, or recommendation in further detail with a credit counselor. The course is not considered complete until the mandatory Online Secured Messaging with Credit Counselor [credit counselor to debtor(s)] has taken place after completion of the online portion.
Terms and Conditions
  1. Fee policy, including any fees associated with generation of the certificate; The Credit Counseling instruction fee is $24 for individual and $25 for joint filers, we do not charge a separate or additional fee for the generation of the certificate.
  2. Policies enabling clients to obtain counseling services for free or at reduced rates based upon the client's lack of ability to pay:
    We provide the Credit Counseling course to any debtor student without regard to the debtor's ability to pay the course fee. A fee waiver may be obtained if filer(s) meet the following requirement: Filer(s) must be below 150% of the HHS Poverty Guidelines of the current year. If you meet this requirement you must submit your last year's tax return (as proof of income) and a letter requesting a fee waiver to Please allow one business day for processing prior to taking the class. You will be notified via email with instructions on how to proceed to take the class. If you don't have tax returns please provide us with a document that demonstrates you meet the requirement (e.g. Welfare Statement).

  3. Policy regarding limited English proficient client; $0$ BK Class, Inc. offers its services in English only. If the debtor wishes to take the course in a language other than ones mentioned, $0$ BK Class, Inc. will promptly refer the debtor to an approved provider that offers the course in the debtor's preferred language at no cost. The provider that you are referred to may charge a fee for taking the course.
  4. The agency's funding sources; Our funding sources come from the collection of the courses' fees. These include the Pre-Petition Credit Counseling and the Pre-Discharge Debtor Education fees.
  5. The counselors' qualifications; Our Certified Credit Counselors are certified every year through a third party that offers certification and continuing education for Credit Counselors. Managers have at least 5 years of previous lending experience or 5 years in the financial industry.
  6. $0$ BK Class, Inc. dba will not report any information provided by the debtor or regarding this course to any credit reporting agency. Taking this course will not negatively affect the debtor's credit report. However, bankruptcy or choosing an alternative to bankruptcy that results in the debtor making less than the contractual payments to creditors does reflect negatively on credit ratings. Bankruptcy alternatives may include, but are not limited to, debt management, debt settlement, making partial payments of the amount due, or non-payment. A credit report reflecting bankruptcy can lower credit scores, remain on credit report for 7 to 10 years and impact the ability to obtain financing for a home, car and other lines of credit. Employers and landlords may run a credit check with written consent from an applicant. A credit report reflecting bankruptcy could have an impact on potential employment and housing. A credit report may reflect the participation in a debt management program. Credit may view participation negatively in a debt management program and not extend lines of credit to participants.
  7. The counselors' qualifications; Our Certified Credit Counselors are certified every two years through a third party that offers certification and continuing education for Credit Counselors. Managers have at least 5 years of previous lending experience or 5 years in the financial industry.
  8. The agency's policy prohibiting it from paying or receiving referral fees for the referral of clients, except under a fair share agreement; $0$ BK Class, Inc. dba prohibits paying or receiving referral fees for Pre-Petition Credit Counseling Program referrals.
  9. We will issue a certificate of completion within one business (via email to the primary email address on file), after the entire instruction (including the online portion, AND online messaging with a Credit Counselor) has been completed. If the debtor requests at the time of registration to have the certificate emailed to his/her attorney, the debtor is solely responsible for following up with their attorney to ensure that the certificate has been received. $0$ BK Class, Inc. dba will not be held liable for certificates that are lost in transition; however, we will resend the certificate at the client's request.
  10. It is $0$ BK Class, Inc's., dba, obligation to provide a certificate promptly upon completion of counseling services.
  11. $0$ BK Class, Inc. dba does not negotiate alternate payment schedules regarding unsecured debt. If the debtor needs such services, we will refer you back to the approved provider list, located at: where the debtor can locate and choose a provider that offers such services. Please beware that the debtor may incur additional fees in connection with such additional services.
  12. Debtor needs to be aware that $0$ BK Class, Inc. might disclose debtor information to the United States Trustee in connection with the United States Trustee's oversight of $0$ BK Class, Inc., or during the investigation of complaints, during on-site visits, or during quality of service reviews;
  13. The United States Trustee has reviewed only the agency's credit counseling services and its services as a provider of a personal financial management instructional course pursuant to 11 U.S.C. 111(d)), and United States Trustee has neither reviewed nor approved any other services the agency provides to clients.
  14. The debtor will receive a certificate only if the debtor completes the entire counseling services.
  15. Certificates of completion are valid for 180 days. Certificates will only be issued for the business day when the entire course (which includes the online portion, AND online messaging with a Credit Counselor) has been completed. If a certificate has expired, the debtor will be required to retake the course to receive a new certificate of completion.
Additional disclosures:
  • $0$ BK Class, Inc. dba is a non-profit agency.
  • In order to verify the identity of each Debtor who is taking the class, each Debtor will be asked to provide their last four of their social security number, date of birth & personal information prior to registering and taking the class.
  • Upon completion of this online registration, each debtor will be emailed a unique "Access Code". The email will be sent to the primary email address on file. You will be asked to enter it to verify your identity at the commencement of course. If you later on take the Pre-Discharge Debtor Education with us, please note that a new and different "Access Code" will be emailed for that course.
